Before Signing a Rental Agreement: Key Points

DO

  1. Treat it seriously – Once signed, both parties are legally bound.
  2. Bring a witness – For discussions/negotiations with the landlord.
  3. Review the written lease – Ensure it includes:
    • Accurate description of the property.
    • Correct names of landlord/tenant.
    • Lease duration and rent amount (confirm it matches verbal agreement).
    • Clarification on who pays utilities (water, electricity, etc.), management fees, and rates.
    • Repair responsibilities (tenant: minor fixes; landlord: major/external repairs).
    • Tenant obligations (e.g., no pets, subletting rules).
  4. Remove unfair clauses – E.g., bans on subletting. Initial any changes.
  5. Check for hidden costs – Premiums, key money, or deposits.
  6. Ensure legal protection – The lease must follow the Landlord and Tenant Ordinance.
  7. Create an inventory – For furnished properties, list all items and their condition.

DON'T

  1. Sign blindly – Read everything. Seek help (e.g., CEDARS) if unsure.
  2. Trust oral promises – Get all terms in writing.
  3. Assume ownership – Verify the landlord owns the property.

Frequently Asked Questions

  1. Minors (under 18): Contracts are voidable unless deemed necessary/beneficial (e.g., housing).
  2. Agents: Valid if they have landlord’s authority (e.g., keys). Verify ownership documents.
  3. Written leases: Required for leases >3 years. Always get written terms.
  4. Illegal clauses: E.g., waiving tenant rights under the Ordinance – these are invalid.
  5. Sharing flats:
    • One tenant can sign, but they’re solely responsible.
    • Remove "no subletting" clauses or use a "licence" for roommates (risky).
  6. Breaking a lease: Landlord can claim unpaid rent from the security deposit.
  7. Landlord termination: For major breaches (non-payment, unauthorized subletting).
  8. Property sold? New owner must honor the existing lease.
  9. Rent increases: After lease ends, negotiate or apply to Lands Tribunal for fair market rent.
  10. Proof of payment: Use receipts, cheques (keep records), or witnesses.
  11. Security deposits: Only refundable if no lease is signed. If signed, forfeited if you back out.
  12. Repairs: Follow lease terms. If unclear, maintain the property in "tenant-like manner."

Key Reminders:
  • Never skip written agreements.
  • Clarify all financial responsibilities upfront.
  • Keep copies of all documents (lease, receipts, inventory).
